The ability to use a patented technology for commercial gain is the
main reason for obtaining patent protection. However, having an issued
patent is only one part of the process – in order to be able to market
a product, that product cannot infringe on patents that are embodied in
other products. In other words, a company must have the “freedom to
operate” in the marketplace. For example, you may have a
patent on a new type of miracle coating that makes widgets last longer.
The process you envision for applying this coating involves spraying
widgets as they go by. However, another company holds a key patent on
spray coating equipment that describes the technology you
need to use in order to coat widgets. In this case, you do not have
"freedom to operate". One potential resolution would be to license the
rights to use the spray coating equipment patent.
